Earpin is not a product of Apple Inc. Use of the service requires an active Apple Music subscription. All audio content is played exclusively through Apple Music. Earpin does not store or stream any audio data.
1. Scope
These Terms of Service govern the use of the Earpin iOS app and the website earpin.app (together the "Service"), offered by (hereinafter "Provider"):

By installing the app or using the Service, you agree to these terms. Please read them carefully. If you do not agree, do not use the Service.
2. Description of the Service
Earpin is an iOS app that tracks audio drama progress for Apple Music users. The Service includes:
- Saving the playback position and cross-device synchronisation via your iCloud
- Automatic detection of the episode order in audio drama series
- Management of a personal audio drama library and up-next list
- Resuming playback in Apple Music at the exact position
Earpin does not transmit or store any audio data. All audio content is streamed exclusively through Apple Music.
3. Requirements
The following requirements must be met to use Earpin:
- Apple Music: an active Apple Music subscription
- iOS 15.1 or later
- Minimum age: 13 years. In the European Union, entering into contracts requires a minimum age of 16 years or the consent of a parent or guardian.
- An Apple ID account for the App Store
4. License
The Provider grants you a limited, non-transferable, non-exclusive, revocable licence to use the Earpin app for private, non-commercial purposes.
The following actions are prohibited:
- Reverse engineering, decompiling, or disassembling the app
- Commercial resale or licensing to third parties
- Automated access to the Service (scraping, bots)
- Circumventing technical protection measures
5. Subscriptions & Pricing
Earpin can be tried for 7 days free of charge and without entering any payment details. After that you need a purchase to keep using Earpin. You can choose between a subscription (monthly or yearly, renewing automatically) and a one-time purchase with no term. The prices that apply are shown in the App Store and in the app before you buy.
Your existing data stays visible once the trial ends: progress, notes and library are neither deleted nor locked.
Billing via Apple
In-app purchases are processed exclusively through the Apple App Store. Apple's Terms of Service apply. Payment information is processed solely by Apple and is not shared with the Provider.
Cancelling Your Subscription
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period via iOS Settings → Apple ID → Subscriptions. Cancellation via support@earpin.app is not possible.
Refunds
Refund requests are handled in accordance with Apple's policies. Please contact Apple Support directly.
6. User Obligations
You agree to use the Service exclusively for lawful purposes and in particular to:
- not provide false information to the Provider
- not use the Service in a way that harms other users or disrupts operations
- not distribute content that violates applicable law
- comply with the Apple Music (Apple Media Services) Terms of Service
7. Liability & Availability
The Service is provided in a beta stage. The Provider does not guarantee uninterrupted availability, freedom from errors, or completeness of the Service.
Limitation of Liability
The Provider's liability is limited to cases of intent and gross negligence. For ordinary negligence, the Provider is only liable for breach of material contractual obligations (cardinal obligations), and only up to the foreseeable, contract-typical damage.
The Provider is not liable for:
- Changes to or interruptions of Apple Music services or interfaces by Apple Inc.
- Data loss arising from uninstalling the app or switching devices where iCloud sync is not active
- Errors in content within Apple Music metadata (album titles, track order)
Availability
The Provider reserves the right to suspend or permanently discontinue the Service. In the event of permanent discontinuation, active subscribers will be informed at least 30 days in advance and will receive a pro-rated refund.
8. Intellectual Property
All rights to the Earpin app, its design, code, and the content of the website earpin.app belong to the Provider unless otherwise stated.
Apple®, Apple Music®, and related marks are registered trademarks of Apple Inc. Earpin is not affiliated with, sponsored by, or endorsed by Apple Inc.
9. Termination
You may stop using the Service at any time by uninstalling the app. You can delete all your data, on your device and in your iCloud, via Settings → Delete All Data in the app.
The Provider may restrict or terminate access to the Service in the event of a serious breach of these Terms of Service. In such cases, active subscriptions will be refunded on a pro-rated basis.
10. Governing Law & Dispute Resolution
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers within the EU: notwithstanding the choice of law, you retain the benefit of any mandatory consumer protection provisions of the country in which you are habitually resident.
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Changes to These Terms
The Provider reserves the right to amend these Terms of Service. Material changes will be announced in the app at least 14 days before they take effect. Continued use of the Service after the changes take effect constitutes acceptance of the amended terms.
